style="vertical-align: inherit"><span style="vertical-align: inherit"><span style="vertical-align: inherit"><span style="vertical-align: inherit"><span style="vertical-align: inherit"><span style="vertical-align: inherit">依照勞動基準法第36條第1項：「勞工每七日中應有二日之休息，其中一日為例假，一日為休息日。」依照本條文規定，可知勞工原則上每七日應有二日之休息，其中有一天例假日，另一天為休息日。例假日原則上不得上班，除非有勞動基準法第40條因天災、事變或突發事件，雇主認有繼續工作之必要，始得請勞工上班。而關於例假跟休息日，只要勞資雙方協議同意即可，並無硬性規定必須為星期六與星期日，且休息日與例假日可經由勞雇雙方同意予以調整，惟不得違反「不得連續工作逾六日」之規定。以下針對休息日及例假日分述之：</span></span></span></span></span></span></span></span></span></span></span></span></p><p><span style="vertical-align: inherit"><span style="vertical-align: inherit">（一） 休息日</span></span></span></span></span></span></span></span></span></span></span></span></p><p><span style="vertical-align: inherit">休息日之出勤較為彈性，性質上屬於工作時間的延長，休息日可以經勞工同意加班，由雇主加給加班費出勤，並依照勞動基準法第24條第2項、第32條及第36條第3項之規定，加給休息日工作之工資。</span></span></span></span></span></span></span></span></span></span></span></span></p><p><span style="vertical-align: inherit"><span style="vertical-align: inherit"><span style="vertical-align: inherit"><span style="vertical-align: inherit"><span style="vertical-align: inherit"><span inherit">除非有勞動基準法第40條規定之事由，原則上例假日不得上班。然而，針對某些產業，因需要更有彈性的工作時間，故有調整例假之需求。為此，因應某些具有「時間特殊」、「地點特殊」、「性質特殊」或是「狀況特殊」的行業，勞動部准予該等行業於事前徵得勞工同意後，採行彈性工時制度，於二周期內適當調整原定之例假，使其間隔多至十二日。前述特殊行業別可參（勞動部勞動條3字第1100130339號公告之行業附表），該等行業可經中央目的事業主管機關同意，而其行業雇主須經過工會/勞資會議同意後，可例外於每7日之週期內調整所定之例假，使勞工合法連續上班至多12日。</span></span></span></span></span></span></span></span></span></span></span></span></li><li><span 										<content:encoded><![CDATA[<p>致力於有機半導體材料之開發，結合新興光電應用的天光材料，成立於2014年，專攻有機半導體材料的材料結構設計與合成技術，共有兩個應用市場: (一)、柔性第三代光伏技術。 (二)、光傳感器用於影像或生物感測器。天光材料成為台灣唯一被收錄於美國再生能源實驗室(National Renewable Energy Laboratory)所建立之「Best Research-Cell Efficiency Chart」的機構，這是在有機半導體光伏技術的重要里程碑。緊隨其後在2021年裡成功開發下世代NIR-SWIR CMOS影像感測器的半導體有機材料並取得半導體光學元件製造廠及各大面板廠商客戶的供應商資格。為了進一步對客戶提供更高品質的產品與服務，並展現對環境、社會及經濟之均衡發展的承諾，在2022年10月，天光材料委託華宇企管顧問輔導團隊，導入ISO 9001/14001 品質與環境管理系統。</p>

									<p style="text-align: justify"><strong>　　即將邁入第四季的現在，企業的人資或管理部門陸續展開年度結算或新年度計畫規劃作業；其中年度行事曆為企業日常運行之基礎，所有的規劃與活動皆隨之展開。看似很一般的長態工作其實與公司的管理績效卻有著息息相關的重要性，那如何在常態工作中找到更聰明的規劃，讓年度行事曆的安排能幫助企業運作更有效能是有幾個關鍵的要素。</strong></p><h3 style="text-align: justify"><span style="color: #16a085">■ 政府與企業其實可不同</span></h3><p style="text-align: justify">2023年度公務機關行事曆已由政府相關部門核定後公布，民間企業大部分皆參考政府部門之行事曆，以作為企業本身行事曆之重要參考依據。那企業在規劃新年度行事曆還有哪些事項須留意呢？</p><p style="text-align: justify">首先，須留意的是政府機關與私人企業所依據之法令不同。「政府機關辦公日曆表」僅適用於政府機關；民間企業之放假，須依照勞動基準法及其他法令規定，由勞資雙方協商處理。</p><h3 style="text-align: justify"><span style="color: #16a085">■ 企業行事曆需符合勞基法</span></h3><p style="text-align: justify">其次，行事曆排定方面以常日班為例，須在行事曆上明確標記那些日期為工作日、休息日、例假日與國定假日；如有挪移之需求，須清楚記載挪移的日期，而挪移後亦須留意法定工時之規範，勿有每週工時超過40小時上限之法令規定。切記須遵守連續工作七日，須有一日為休息日，一日為例假日之法令最基本要求。至於輪班制部分，為因應營運需求，企業內可能同時有各種班別如三班制、四班二輪制或其他班別同時運行；因其關係到各類變形工時法令之適用，為讓企業日常運作順暢，建議一併送勞資會議討論通過實施。</p><h3 style="text-align: justify"><span style="color: #16a085">■ 行事曆需勞資雙方依共識與結論產生才合法</span></h3><p style="text-align: justify">最後，新年度行事曆排定後，還有一步驟切勿忽略。記得須將行事曆送交工會或勞資會議，進行討論與協商，取得勞資雙方之共識與結論，完成應有程序；同時為避免日後爭議，勞資雙方做成決議後應通知全體員工，或公告於公司明顯之處，才不會有違法之虞，並為勞資雙方共同所遵循。</p><p> </p><h3 style="text-align: justify"> 【作者簡介】 </h3><h4 style="text-align: justify"><strong><span style="color: #0000ff">李名田 華宇企管 勞資顧問師</span></strong></h4><p style="text-align: justify">高苑科大企管系”人力發展專業人員”學程業師 </p><p style="text-align: justify">   <strong>&#8211;專長：</strong> </p><p style="text-align: justify">　　1.勞動相關法規建議與諮詢<br />　　2.勞資爭議調解<br />　　3.人資制度優化。<br />　　4.勞動條件、勞資爭議、大量解僱處理、就業歧視認定、性別工作平等、職業災害認定</p><p style="text-align: justify">    <strong>&#8211;輔導實績：</strong> </p><p style="text-align: justify">　　華新麗華LED光電事業處、力成科技、元晶太陽能….等企業。</p><p> </p>								</div>

									<p style="text-align: justify">　　因應現代社會型態的改變，勞工意識升高，勞動相關法令不斷地修改，導致公司及企業在管理上往往無所適從，也容易在不經意的情況下違反了勞基法相關規範。企業要能穩定發展，勞資關係的和諧為不可或缺的條件之一，以下僅就勞工的薪資及休假簡要說明，希望對讀者有所助益。</p><p> </p><h3 style="text-align: justify"><span style="color: #16a085">一、工資是甚麼？</span></h3><p style="text-align: justify">依照勞動基準法第 2 條第 3 款：「本法用詞，定義如下：三、工資：指勞工因工作而獲得之報酬；包括工資、薪金及按計時、計日、計月、計件以現金或實物等方式給付之獎金、津貼及其他任何名義之經常性給與均屬之。」，依照本條文規定，可知「工資」係指「因工作而獲得之報酬」。然而，法院實務上，則係將「工資」定義為「勞工因工作而獲得之報酬」且須具備「經常性給予」之特質。</p><p style="text-align: justify">另依照勞動基準法施行細則第 10 條規定，可知公司企業給予勞工之紅利、獎金、補助費、雇主致送之賀禮、補償費、交際費等非經常性給予且非勞務對價之項目，將不被認定為工資。提醒讀者，<strong>關於「工資」之認定，係以該項目是否為公司企業經常性給予且是否為勞務對價實質判斷，並不以給付「名目」為斷。</strong></p><h3 style="text-align: justify"> </h3><h3 style="text-align: justify"><span style="color: #16a085">二、關於「工資」之常見問題</span></h3><p style="text-align: justify">（一）基本工資：依照勞動基準法第 21 條規定，工資由勞雇雙方議定之，但不得低於基本工資。基本工資自民國 111 年 1 月 1 日起調整，月薪由 24,000 元調高至 25,250 元，每小時基本工資調整為 168 元，就「基本工資」常見的問題簡要說明如下：</p><p style="text-align: justify"> </p><p style="text-align: justify">1. 勞工之底薪低於基本工資違法嗎？</p><p style="text-align: justify">勞工之底薪低於基本工資並不當然違法， 若除了底薪以外，尚有其他名目之經常性給予勞務對價所得，其合計高於基本工資之金額，即為法所允許。</p><p style="text-align: justify"> </p><p style="text-align: justify">2. 與勞工約定每月報酬為基本工資，若因勞工請假、遲到，導致當月工資低於基本工資，是否合法？</p><p style="text-align: justify">「基本工資」係指勞工在「正常上班時間內」所能獲得之報酬，若因勞工請假或遲到而致當月領取之薪資低於基本工資，並不違法。但是，若員工的薪資結構為「全勤獎金」加上「底薪」為「基本工資 」者，當員工當月請假一日，雇主亦僅得按比例扣除一日工資（計算：基本工資 ÷ 30 日× 1 日事假），不得再扣除全勤獎金，否則將與法有違，換句話說，全勤獎金制度將失去其意義，可參（行政院勞工委員會民國 77 年 7 月 26 日 77 台勞動 2 字第 14423 號函）。</p><p style="text-align: justify"> </p><p style="text-align: justify">（二）工資給付及扣除：依照勞動基準法第 22 條及第 23 條規定，工資給付應依照「通貨給付」、「定期給付」、「全額給付」、「直接給付」之原則辦理，亦即公司企業在給付工資時，應以通用之貨幣，定期並全額將工資直接給付勞工。且依照勞動基準法第 25 條及第 26 條之規定，公司企業在給付工資時，應注意需「男女平等同工同酬」且「不得預扣工資」。</p><p style="text-align: justify"> </p><p style="text-align: justify">1. 規定勞工須分擔貨物運送中毀損之賠償金額可以嗎？</p><p style="text-align: justify">勞動基準法第 26 條規定：「雇主不得預扣勞工工資作為違約金或賠償費用。」依照前條規定，預扣勞工工資非法所許。在責任歸屬未明之前，不得預扣勞工工資作為賠償金。在勞工有違約、賠償等事實未發生，或其事實雖已發生，但責任歸屬、範圍大小、金額多寡等未確定前，雇主逕自預先扣發勞工工資作為違約金或賠償費用者，並不合法，此有（台北高等行政法院 105 年度訴字第 575 號判決）可參。然而，在雇主對於勞工之損害賠償債權已經確定後，則可由勞工工資中抵銷。</p><p style="text-align: justify"> </p><p style="text-align: justify">2. 公司企業停工時，勞工工資可以不發嗎？</p><p style="text-align: justify">應視具體停工原因而有不同處理： </p><p style="text-align: justify"> </p><p style="text-align: justify">（1）停工原因可歸責於雇主或為雇主之經營風險時：工資應照常給付。 </p><p style="text-align: justify">（2）停工原因可歸責於勞工者：雇主得不發給工資。</p><p style="text-align: justify">（3）停工原因係雇主與勞工雙方均不可歸責者：除非雙方另有約定，否則雇主不必給付工資，而勞工亦不必補服勞役。</p><p> </p><p style="text-align: justify">3. 公司企業可以用「減薪公告」的方式降低薪水之給付嗎？</p><p style="text-align: justify">依照勞動基準法第 22 條第 2 項之規定，除非法令另有規定或勞雇雙方另有約定，工資應全額直接給付勞工。「減薪公告」本質上係雇主單方片面減少勞工之薪資，依前條規定，除非與員工協商，否則原則上雇主應依照勞動契約約定之工資全額給付，不得片面減薪。</p><p style="text-align: justify"> </p><p style="text-align: justify">綜上所述，工資為勞工因工作而獲得之報酬且須具備經常性給予之特質，而工資之發放，原則上應定期並全額將工資直接撥付予勞工，在給付工資時，應注意須男女同工同酬且不得預扣工資，以上就工資及給付方式為簡要說明，下一篇將再介紹勞工之休假規定。</p><p style="text-align: justify"> </p><p style="text-align: justify"><em>資料來源:貝爾驗證月刊 </em></p>								</div>

									<p>　　軟體攻擊、智財權遭竊或被破壞僅為公司組織所面臨眾多資安風險中之一部分。而所造成的後果可能巨以難估。大多數組織均有管控措施加以保護，但如何才能確保這些管控措施足以勝任？近期更新之國際資安管控評估參考指南可提供相關協助。</p><p>對於任何組織而言，資訊是其最有價值的資產之一，資料洩露能導致如業務損失和損失清理等帶來重大耗費。因此，現有的管控必須嚴格到足以提供保護，並定期監控以跟上不斷變化的風險。</p><p>由 ISO和國際電工委員會（IEC ）所發展，<em><a href="https://www.iso.org/obp/ui/#iso:std:iso-iec:ts:27008:ed-1:v1:en" data-cke-saved-href="https://www.iso.org/obp/ui/#iso:std:iso-iec:ts:27008:ed-1:v1:en">ISO/IEC TS 27008</a></em><em> 資訊技術 </em><em>&#8211;</em><em>安全技巧 </em><em>&#8211;</em><em>資安管控評估指南</em>，為評估現有管控措施提供指引，以確保該措施能卓有成效地適用其目的並符合公司目標。<em> </em></p><p>技術規範（TS ）近期已更新，以符合新版資安管理的其他補充標準，即 ISO / IEC 27000 (概述和詞彙)、ISO / IEC 27001(要求)和 ISO / IEC 27002(資安管控實務準則)，這些標準均於該技術規範中有所參引。</p><p>發展該標準的工作小組負責人Edward Humphreys教授表示，ISO / IEC TS 27008將幫助組織對經由實施 ISO/IEC 27001標準管理的現有管控方式進行評估與審查。</p><p>該教授說：「在這個世界裡，網路攻擊不僅更頻繁，而且越來越難以發現和預防，現有安管措施的評估與審查需要定期進行，且應作為組織業務程序的一個重要面向。」</p><p>「ISO / IEC TS 27008可以幫助組織確信他們的控制措施是有效、充分且適當的，以減輕組織所面臨的資訊風險。」</p><p>ISO / IEC TS 27008對所有類型和規模無論是公營、民營還是非營利性的組織均有助益，並且可對ISO / IEC 27001中所定義之資安管理系統予以補述。</p><p><em>【取材自ISO官方網站】網站</em></p>								</div>
